I.  Receipt of Request for Waiver Form

Upon request of a Continuing Education Waiver Request Form, the waiver applicant shall be forwarded an Agreed Cease and Desist Order. Should the applicant fail to execute and comply with the Agreed Cease and Desist Order after the waiver has been granted by the Continuing Education Committee or its designee, the Committee may request disciplinary action against the applicant for noncompliance of the CE requirements in accordance with the Continuing Education Rules for Court Reporters. If the applicant desires to practice shorthand reporting during the initial approved waiver period, he/she must immediately notify the Court Reporters Certification Board in writing. At that time, the applicant must complete continuing education (CE) units prorated for the period granted under the waiver.

II.  Returning to Shorthand Reporting after a Waiver is Granted

If the reporter has been inactive or retired for a duration of one renewal period, the reporter will be required to take a five-minute literary test in the CRCB office or the office of the tester. If the applicant is unsuccessful on the private five minute literary exam, then the applicant must take the next public oral examination administered by the Board on a quarterly basis.

If the reporter has been inactive or retired for a period of two renewal periods, the reporter will be required to take a five-minute literary test as well as a written test on Texas Rules, in the CRCB office or the office of the tester. If the applicant is unsuccessful on the private five-minute literary exam and/or the written test on Texas Rules, then the applicant must take the next public oral and/or written examination administered by the Board on a quarterly basis.

If the reporter has been inactive or retired for three (3) or more renewal periods, the reporter will be required to take the previously given three-section skills test as well as a written test on Texas Rules. This test is to be administered in the CRCB office or the office of the tester. If the applicant is unsuccessful on the private three-section skills examination and/or private written exam, then the applicant must take the next public oral and/or written examination administered by the Board on a quarterly basis. 

The three-section private or public oral examination must consist of: (1) five minutes of two-voice dictation of questions and answers given at 225 words per minute, (2) five minutes of dictation of jury charge given at 200 words per minute, and (3) five minutes of selected literary material given at 180 words per minute. Each applicant must personally take down the test either in his or her own writing or voice. The oral exam may be with or without transcription of the test material at the option of the examiner. The minimum passing grade on each section of the test is ninety-five percent (95) accuracy. A dictionary may be used during the oral test.

The private written examination must consist of questions on Texas Rules relating to court reporting. The public written examination consists of questions relating to elementary aspects of court reporting, spelling, and grammar. The minimum passing grade for the written exam is seventy-five (75) percent. A dictionary may not be used during the written test.

III.  Important Waiver Information

Approved waivers are not approved indefinitely/permanently. You must request a waiver for each renewal period.

You will receive an Agreed Cease & Desist Order when you request a CE Waiver form. This MUST be completed and returned to the Board office along with your completed waiver form. It is advisable to keep a copy for your records before you return the completed originals to the Board office.
